Digital Image Licensing Terms

Thank you for supporting Brad Revard Fine Arts Photography. By purchasing, downloading, accessing, or using a digital photograph from this website, you acknowledge that you have read, understood, and agree to the terms of this Digital Download License.

1. Ownership and Copyright

All photographs, digital images, artwork, and related visual content made available through Brad Revard Fine Arts Photography remain the exclusive intellectual property of Brad Revard, unless otherwise expressly stated in writing.

Purchasing or downloading a digital image does not transfer ownership, copyright, or intellectual-property rights in the photograph to the purchaser.

The photograph remains protected by applicable copyright laws.

2. License Granted

Upon successful purchase, the purchaser is granted a limited, non-exclusive, non-transferable, revocable license to use the purchased digital image for the specific personal or commercial purposes permitted by the license selected at the time of purchase.

This license grants permission to use the image. It does not constitute a sale or transfer of copyright ownership.

3. Personal Use

Unless a commercial license has been specifically purchased, digital downloads are licensed for personal, non-commercial use only.

Permitted personal uses may include:

Personal computer, tablet, or mobile-device wallpaper

Personal digital display

Personal printing for home or private display

Personal gifts

Personal social-media use, provided the image remains properly credited and is not presented as the purchaser's own work.

4. Commercial Use

Commercial use requires an appropriate Commercial or Extended Commercial License unless otherwise authorized in writing by Brad Revard Fine Arts Photography.

Commercial use may include, but is not limited to:

Advertising or promotional materials

Business websites

Marketing campaigns

Product packaging

Publications

Paid social-media advertising

Merchandise

Resale products

Business décor

Promotional materials produced for a business or organization

If you are uncertain whether your intended use qualifies as commercial use, please contact Brad Revard Fine Arts Photography before using the image.

5. Prohibited Uses

Unless expressly authorized in writing, the purchaser may not:

Resell, redistribute, sublicense, or transfer the digital image

Upload the original high-resolution file to stock-photography websites or image libraries

Claim the photograph as their own work

Remove, obscure, alter, or replace copyright notices or ownership information

Remove a watermark or other identifying information without authorization

Use the photograph to create or sell derivative products

Use the photograph in a way that falsely implies endorsement, sponsorship, or affiliation with Brad Revard Fine Arts Photography

Use the photograph for unlawful, defamatory, fraudulent, or misleading purposes

Share the original downloadable file with another person, business, organization, or third party

Make the image available for public download or distribution

6. Editing and Alterations

The purchaser may not materially alter, manipulate, retouch, composite, reproduce, or otherwise modify a licensed photograph without written permission from Brad Revard Fine Arts Photography, except where such modifications are expressly permitted by the applicable license.

Cropping or minor adjustments made solely for personal display may be permitted, provided that the photograph is not misrepresented or presented as another photographer's work.

7. Social Media Use

Personal social-media sharing is permitted when the image is used in accordance with the purchased license.

Social-media use does not grant permission to download, redistribute, sell, modify, or otherwise exploit the original high-resolution image.

8. Copyright and Attribution

Where attribution is required or reasonably practical, the following credit is requested:

Unauthorized removal of copyright information, watermarks, attribution, or other ownership identifiers may constitute an infringement of the photographer's rights.

9. No Transfer of Ownership

The purchaser receives a license to use the image under the terms specified herein.

The purchase of a digital download does not:

Transfer copyright

Transfer ownership of the photograph

Grant exclusive rights

Grant unrestricted commercial rights

Grant the right to sublicense the photograph

Grant the right to redistribute the original file

All rights not expressly granted by this license remain with Brad Revard Fine Arts Photography.

10. Unauthorized Use

Any use outside the permissions granted by the applicable license may constitute unauthorized use and may result in enforcement of the photographer's intellectual-property rights.

Unauthorized use may include reproduction, distribution, commercial exploitation, alteration, removal of ownership information, or use beyond the scope of the purchased license.

Brad Revard Fine Arts Photography reserves all rights and remedies available under applicable law.

11. Digital File Delivery

Digital products are delivered electronically using the delivery method specified at the time of purchase.

Because digital products can be copied once delivered, all sales are generally considered final and non-refundable, except where required by applicable law or where Brad Revard Fine Arts Photography determines that a refund or replacement is appropriate.

12. License Termination

This license automatically terminates if the purchaser violates any of its terms.

Upon termination, the purchaser must immediately discontinue use of the photograph and delete any unauthorized copies in their possession or control.

Termination does not limit any other rights or remedies available to Brad Revard Fine Arts Photography.

13. No Warranty

Digital images are provided in the format and resolution specified at the time of purchase.

While reasonable care is taken to ensure the quality and integrity of digital files, Brad Revard Fine Arts Photography does not guarantee that a particular image will produce identical results across every device, monitor, printer, printing service, software application, or display medium.

14. Acceptance of Terms

By purchasing, downloading, accessing, or using a digital photograph from Brad Revard Fine Arts Photography, you acknowledge that you have read and agree to the terms of this Digital Download License.

If you do not agree to these terms, you must not use the digital image.
